Overview and Definitions

 

In this Policy:

‘Centre Management’, ‘Our’, ‘We’ or ‘Us’ refers to Central Fair No.7 Pty Ltd ACN 659 885 499 as trustee for the Central Fair No.7 Trust.

‘You’ or ‘Your’ refers to the anyone from whom We collect information.

We respect the privacy of Personal Information and have published this policy to provide practical guidance outlining the usual ways We treat that information. 

 

We collect, hold, use and disclose Personal Information to carry out Our business functions and activities.  These functions and activities involve the provision of retail and commercial services to customers, tenants and visitors to the City Arcade and City Lane Townsville shopping precinct (the Precinct).  The Personal Information We collect may also be used for Our other ancillary business activities.

This privacy policy does not address every aspect of how Personal Information is treated and will not apply to information that falls outside the Privacy Act 1988 (Cth) (Act) and Australia’s other privacy laws that may apply to Our business.

By using any of Our services, visiting Our website https://citylane.com.au  or giving Us Your Personal Information, You agree to Your information being collected, stored, used and disclosed as set out in this Privacy Policy.

What is personal / Sensitive Information?

 

Personal Information: Personal Information has the meaning given to it under the Act.  As such, it means:

‘information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and

  2. whether the information or opinion is recorded in a material form or not.’

Sensitive Information: Sensitive Information has the meaning given to it under the Act and may include information about Your health, race, ethnicity, beliefs, criminal history, political or other associations and genetic or biometric information

If You choose not to provide Us with Your Personal Information, We may not be able to provide You with the products and services You require, or deliver the level of service which We expect to provide to you.

Whose Personal Information We collect

 

We may collect and hold information including (but not limited to) Personal Information about:-

  • tenants and purchasers, potential tenants and purchasers, business associates and their employees;

  • visitors to Our website;

  • contractors;

  • job applicants;

  • suppliers and their employees;

  • people who elect to receive Our mailing lists; and

  • others with whom We come into contact.

 

What Personal Information We collect

 

The Personal Information We collect and hold may include:-

  • full name;

  • address;

  • telephone numbers (including home, work and mobile);

  • facsimile numbers;

  • email addresses;

  • occupation of people and the industry they work in.

 

How We collect Personal Information

 

While We will usually collect information directly from You, Personal Information may be collected from You in a number of different ways including:-

  • face-to-face meetings;

  • telephone conversations;

  • the documentation provided to Us;

  • business cards;

  • interviews;

  • Our website;

  • emails and written correspondence that You send Us;

  • Our mailing lists;

  • third parties, for example, a credit reporting agency;

  • Your representatives; and

If You supply Us with information about another person, You should ensure You are authorised to do so.

You must inform that person who We are, that We will use and disclose their Personal Information as outlined in this Privacy Policy from time to time and that they have certain rights to access the personal information that We hold about them.

If You have referred Us to third parties to obtain personal and other information about You We will assume, and You must ensure, that the third party is aware that You have referred Us to them and of the purposes involved in the collection, use and disclosure of Your Personal Information.

Use and disclosure of Your Personal Information

We only collect Personal Information that is necessary for Us to deal with Your requests, to provide Our products and services to You, to develop and promote Our products and services, and to assist Us with complying with Our legal and regulatory obligations. This includes:-

  • providing the services that You have requested from Us;

  • administering and managing those services including charging, billing and collecting debts;

  • conducting appropriate checks for credit-worthiness where You have applied for credit;

  • communicating with You;

  • enabling Our related entities to assist You with related services as required;

  • researching, developing and enhancing Our services;

  • maintaining and developing Our business systems; and

  • complying with Our legal obligations.

 

If You no longer wish to receive marketing and promotional material from Us, please telephone Us on telephone ph. 0428 721 684 and We will remove Your details from Our mailing list. Alternatively, You can send Your request in writing to Us addressed to hello@citylane.com.au

As well as using Your Personal Information for the primary purposes for which You provided it to Us, We may also use the information for related secondary purposes, although We will endeavour to contact You for Your express consent should the secondary purpose be one which We consider You may not reasonably expect. Examples of related secondary purposes include:-

  • insurance purposes;

  • exchanging information with a subsidiary entity and Our agencies;

  • quality assurance purposes; and

  • other related purposes.

 

We may share, use and disclose Your Personal Information within other Related Entities of the Centre Management.

The people/organisations to which We disclose Your Personal Information to may include:-

  • Our staff members;

  • credit reporting agencies;

  • contractors and outsourced service providers who manage the services We provide to You, including:-

    • information technology services;

    • installation, maintenance and repair services;

    • market research organisations; and

    • debt-recovery agencies;

  • Your authorised representatives;

  • Our professional advisers, including Our accountants, and auditors;

  • government and regulatory authorities and other similar organisations, as required or authorised by law; and

  • Our Related Entities.

 

While We do not directly disclose any Personal Information overseas, it may be held at locations outside of Australia in the following circumstances:

 

  • in connection with the processing of web traffic information disclosed to Google Analytics when You visit Our websites. Google stores information across multiple countries;

  • where Your Personal Information is stored on secure cloud storage and the service provider may have servers located overseas; and

  • where the disclosure is necessary to protect Our legitimate interests.

 

Changes and access to Your Personal Information

We are committed to keeping Our records up-to-date and We encourage You to tell Us when Your details (such as Your telephone number, address or name) change.

Before We can deal with Your request, We will need to verify Your identity before We provide access to Your information or make any corrections to it and We may ask for evidence supporting Your requests for corrections.  We will do Our best to respond to any requests within 30 days.  If We refuse to provide access to or correct Your information, We will notify You of Our reasons in writing and comply with any applicable laws in that regard.

You can request access to the Personal Information We hold about You if You wish to do so. If We are unable to provide You with access, We will explain why. We also reserve Our rights to charge a fee for searching for and providing access to Your information to the extent permissible at law to do so.

Generally, this process is free.  However, in the event We do charge a fee that is permitted by law then You will be advised of the approximate fee in advance.

Security of Your Personal Information

We are committed to protecting Your Personal Information from misuse and loss, and from unauthorised access, modification and disclosure, and will take reasonable steps to do so.

Where We engage a third-party service provider, We will make sure that appropriate data handling and security arrangements are in place.

Disposal and destruction of Your Personal Information

We generally hold onto Personal Information until it is no longer needed for the purpose for which it was provided.  If You would like Us to destroy or deidentify any Personal Information provided to Us, please let Us know and We will endeavour to do so to the extent that it is not impractical and We no longer require the information for purposes permitted by law.

The law may entitle You to request that We erase or destroy Your Personal Information in certain circumstances.  Where You make such a request and there are no legal reasons for Us to retain Your Personal Information then We will comply with such requests where required by law.  If We are entitled to hold onto Your Personal Information, then the law may entitle You to request that We restrict access to Your Personal Information in certain circumstances and We will do so where required by law. 

Please note that if We erase or destroy Your Personal Information then in the future We may not be able to contact You in relation to Our business activities and You may have to provide certain information again before We can deal with You. 

If We no longer need or are no longer required to hold Your Personal Information, We may destroy or permanently de-identify that information, without further notice to You.

Sensitive Information

Australian privacy legislation imposes great obligations on Us regarding any collection, use or disclosure We make of Your Sensitive Information.

Usually, We do not collect Sensitive Information. If for some reason We do need to collect Your Sensitive Information, We will only collect it if:-

  • You have expressly consented to Us doing so;

  • We are required to do so by law; or

  • the collection is necessary to establish, exercise or defend a legal claim.

 

Changes to this policy

This privacy policy was last updated in September 2022.  This policy will be reviewed from time to time to take into account new laws and technology, changes to Our operations and other necessary developments.  When this policy is updated, We will publish the updated policy on Our website.  Your continued use of Our website, products or services, requesting Our assistance, or the provision of further Personal Information to Us after this Privacy Policy has been revised, constitutes Your acceptance of the revised Privacy Policy.  Hard copies of the policy can be made available upon request.

Use of Our website and email system

There are several ways in which We collect information through Our websites.  We handle Personal Information obtained through Our websites in the same manner We deal with Personal Information obtained via other means.
